These Terms of Service ("Terms") govern your use of Delta AI, the AI assistant, website, and app described here (together, the "Service"). By using Delta AI, you agree to these Terms. If you don't agree, please don't use the Service.

1. What Delta AI Is

Delta AI is an AI-powered assistant offering chat, code assistance, document generation, image generation and editing, voice conversation, translation, and related features, accessible via web browser and app, with payment options including the Delta token (on Solana and BNB Chain) and card/UPI payments where available.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Delta AI. By using the Service, you confirm you meet this requirement. If you are using Delta AI on behalf of an organization, you confirm you have the authority to bind that organization to these Terms.

3. Your Account

Delta AI does not require a traditional account with a name or email. Your crypto wallet address, or an anonymous device identifier, serves as your account. You are responsible for keeping your wallet secure — Delta AI never has access to your private keys and cannot recover a lost wallet on your behalf.

4. Subscriptions & Payment

• Delta AI offers a free tier and paid plans (Plus, Pro, Vertex), each with its own message and image limits as shown in the app.
• Paid plans can be purchased using the Delta token (Solana or BNB Chain) or, where enabled, by card/UPI via Razorpay.
• Subscription prices are set in USD and paid in the equivalent amount of Delta token at the time of purchase, or in your local currency for card/UPI payments.
• Subscriptions renew for the stated period unless cancelled. Crypto payments are one-time transactions per billing period, not automatic recurring charges, unless otherwise stated at checkout.
• Cryptocurrency payments are generally final and non-refundable due to the nature of blockchain transactions. Card/UPI refunds, where applicable, are handled case by case — contact us through the official channels linked on our homepage.
• Bonus usage from holding the Delta token or from referrals is provided at Delta AI's discretion and may be changed or discontinued at any time, with reasonable notice where practical.

5. Acceptable Use

You agree not to use Delta AI to:

• Generate illegal content, or content that exploits or harms minors
• Attempt to bypass usage limits, security measures, or these Terms through automated means, multiple accounts, or other circumvention
• Generate malicious code, spam, or content intended to deceive or defraud others
• Infringe on the intellectual property, privacy, or other rights of others
• Reverse-engineer, scrape, or resell access to the Service without our written permission
• Use the Service in any way that violates applicable law

We may suspend or terminate access for accounts that violate these Terms.

6. AI-Generated Content

Delta AI uses artificial intelligence to generate text, images, code, and documents. AI-generated content may contain errors, inaccuracies, or outdated information. You are responsible for reviewing and verifying any content before relying on it, especially for important decisions (legal, medical, financial, or safety-related). Delta AI is a tool to assist you, not a substitute for professional advice.

7. Your Content

You retain ownership of the messages, photos, and files you submit to Delta AI, and of the content Delta AI generates for you in response, to the extent permitted by law. You grant us a limited license to process this content solely to provide and improve the Service. You are responsible for having the rights to any content you upload (photos, documents) for editing or analysis.

8. Intellectual Property

The Delta AI name, logo, and branding are the property of Delta AI. The underlying software, design, and infrastructure of the Service are protected by intellectual property laws. These Terms don't grant you rights to our trademarks or branding beyond normal use of the Service.

9. Service Availability

We aim to keep Delta AI available and reliable, but we don't guarantee uninterrupted access. The Service may be unavailable at times due to maintenance, technical issues, or factors outside our control. Features, limits, and pricing may change over time; we'll aim to communicate significant changes through the app or our official channels.

10. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Delta AI is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including reliance on AI-generated content, cryptocurrency price fluctuations, or transaction issues on the Solana or BNB Chain networks (which are outside our control).

11. Termination

You may stop using Delta AI at any time. We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or if required by law. Provisions that by their nature should survive termination (such as intellectual property and limitation of liability) will continue to apply.

12. Changes to These Terms

We may update these Terms as Delta AI evolves. We'll update the "Last updated" date above when we do. Continued use of Delta AI after changes take effect means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles, unless otherwise required by the law of your local jurisdiction.
