Terms of Service

These Terms of Service ("Terms") govern your use of Delta AI, the AI assistant, website, and app described here (together, the "Service"). By using Delta AI, you agree to these Terms. If you don't agree, please don't use the Service.

1. What Delta AI Is

Delta AI is an AI-powered assistant offering chat, code assistance, document generation, image generation and editing, voice conversation, translation, a browser extension (Delta Companion) and related features, accessible via web browser and app, with payment by card and other payment methods available in your region. A Delta token is planned but has not launched, and nothing in the Service is an offer to sell tokens or an investment.

The Delta Companion browser extension is part of the Service and is governed by these Terms. It works only when you tap an action. You are responsible for how you use it on other websites, including following their rules, and it may not work on every website.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use Delta AI. By using the Service, you confirm you meet this requirement. If you are using Delta AI on behalf of an organization, you confirm you have the authority to bind that organization to these Terms.

3. Your Account

You sign in with Google to use Delta AI. Your Google account is how your usage and any subscription are kept for you, so they follow you to any device. Connecting a crypto wallet is optional and is used, if a Delta token is launched, for token-holder perks. You are responsible for keeping your wallet secure. Delta AI never has access to your private keys and cannot recover a lost wallet on your behalf.

4. Subscriptions & Payment

• Delta AI offers a free tier and paid plans (Plus, Pro, Vertex, Vertex Plus), each with its own message and image limits as shown in the app. Build packs (a set number of Delta Build runs paid once) can be bought while on a paid plan; a pack build is used when a build starts and the plan's own builds or allowance are used up, is returned if the build cannot start, and unused builds do not expire while the account exists, even if the plan ends. Every plan also includes a monthly fair-use allowance that depends on how heavy your requests are: very long replies, large coding jobs and many images use more of it. If you reach it, the app tells you and when it resets.
• Delta Code (for developers) is a separate workspace with its own plans: Delta Code, Code Pro and Code Max. Each is a 30-day pass paid once; it does not renew by itself, paying again adds 30 days, and moving up to a bigger Code plan carries over the value of the days left. A Delta Code plan covers only the Delta Code workspace (its chats, files and its monthly Delta Builds), and a Delta AI plan does not include Delta Code. Both can be held on the same Google account.
• Delta Studio (AI video) is a separate product with its own plans: Delta Studio, Studio Pro and Studio Max. Each is a 30-day pass paid once that gives a number of credits; it does not renew by itself, and buying again adds credits and 30 days. Extra credits can be bought while a Studio plan is running. Standard video uses 2 credits a second, Pro 3 and Cinema 8, and converting or remaking a video of up to 1 minute is paid by its seconds, as shown before you make it. A picture made with Create Image uses the credits shown before you make it (usually 1). Credits are used when a video or a preview picture is started and are given back automatically if it fails or is blocked. A preview picture uses 1 credit; Continue adds the next part of a video at the same price per second as the video. Unused credits stay while a plan is running and end when it ends. There is no free Studio plan. Finished videos are kept for 30 days, so please download the ones you want to keep.
• Paid plans can be purchased by card or by other payment methods shown at checkout. Which payment methods are available may differ by country.
• Delta Build (Delta Vertex and Vertex Plus, or with a build pack): you describe a program, or upload an existing project, and Delta AI writes it, runs and tests it in an isolated sandbox (including in a real browser), fixes failures and gives you a zip, and can publish a web page from it at a public link you choose to create. Builds are limited: on Vertex about 10 a day of up to 15 minutes each, on Vertex Plus longer builds of up to 45 minutes; uploads up to 50 MB and finished zips up to 18 MB. Builds count toward your fair-use allowance, except pack builds, which are paid for separately. Zips are kept for 7 days (30 days for builds made inside a project). The code is generated by an AI: review and test it yourself before using it for anything important, and you are responsible for how you use it and for anything you publish.
• Access is delivered instantly online: as soon as a payment is confirmed, the plan is attached to your signed-in Google account. Nothing is shipped.
• Prices are set in US dollars and are charged in the currency of the payment method you use, as shown at checkout.
• Card/UPI subscriptions renew automatically every month (through UPI Autopay or a card mandate) until you cancel. You can cancel at any time by ending the autopay approval in your UPI app or with your bank, or by emailing us at deltaaibnb@gmail.com. Cancelling stops future charges, and you keep your plan until the end of the period you have already paid for.
• An international payment (for example PayPal or an international card, in US dollars) buys a 30-day pass. It does not renew by itself: there is nothing to cancel, and when the 30 days end you can simply buy again. Buying again while a pass is active adds 30 days.
• One-time and yearly passes. Plus, Pro, Vertex, Vertex Plus, Delta Code and Delta Studio can also be bought as a pass paid once: for 30 days, or for 12 months (360 days). A yearly pass costs fewer months than it covers (shown before you pay), does not renew by itself, and has nothing to cancel. A yearly plan gets a fresh monthly allowance (and, for Delta Code, its monthly builds) every 30 days; unused allowance does not carry over to the next 30 days. A yearly Delta Studio pass gives all twelve months of credits at once; they stay while the pass runs and end when it ends.
• Discount codes. A code may take a percentage off a one-time payment (a 30-day pass, Delta Code, Delta Studio or extra credits). Codes do not apply to yearly passes or to monthly plans that renew by themselves, cannot be combined with another code or discount (the better one is used), can be used once per person, have no cash value, and may have an end date or a limited number of uses. A code may take off less than its percentage on some products; the price you will pay is always shown before you pay.
• Invites. Someone new who signs up with your invite link may get bonus free messages and a discount on their first one-time payment. When they make their first payment, you get a personal thank-you code (a percentage off one future one-time payment, valid for 180 days, usable only by you). Rewards are for genuine new people; we may withhold or remove rewards gained through fake or duplicate accounts.

• Bonus usage from referrals (and from holding a Delta token, if one is launched) is provided at Delta AI's discretion and may be changed or discontinued at any time, with reasonable notice where practical.

5. Refunds & Cancellations

• Cancel any time. Cancelling stops future charges, and you keep your plan until the end of the period you have already paid for.
• Delta AI is a digital service that you can use straight away, so payments for a billing period that has already started are generally not refundable, and we do not give partial refunds for unused time.
• We will refund you for the affected charge if you were charged twice or by mistake, if you were charged after cancelling in time because of an error on our side, or if the paid features were unavailable to you for a long time because of us. Please contact us within 7 days of the charge.
• Where the law gives you a right to cancel or to a refund, that right is not affected by this section.
• How to ask: email deltaaibnb@gmail.com from the address on your account, with the date and amount of the payment. We will reply as soon as we reasonably can. Approved refunds go back to the original payment method, and how long they take to appear depends on your bank or card issuer (usually 5 to 10 business days). International payments are refunded through the same payment processor to the original payment method.

6. Acceptable Use

You agree not to use Delta AI to:

• Generate illegal content, or content that exploits or harms minors
• Attempt to bypass usage limits, security measures, or these Terms through automated means, multiple accounts, or other circumvention
• Generate malicious code, spam, or content intended to deceive or defraud others
• Infringe on the intellectual property, privacy, or other rights of others
• Reverse-engineer, scrape, or resell access to the Service without our written permission
• Use the Service in any way that violates applicable law
• Use the Service in a way that breaks the usage policies of the AI providers we use

We may suspend or terminate access for accounts that violate these Terms.

Videos made with Delta Studio. Do not make videos of real, identifiable people (by name, or from their photo) without their permission, videos that pretend to be real news or real events in order to deceive, sexual content, or anything involving children in an unsafe way. Only start a video from a photo you took or have the right to use, and only with the agreement of the people in it. "Video of me" is for a photo of yourself, or of another adult who has agreed; never use a photo of a child or of someone who has not agreed. Delta Studio refuses requests for real, named people and unsafe content, and the video engine has its own safety checks; a blocked video gives its credits back. Videos from the video engine carry an invisible digital watermark that marks them as AI-made. You are responsible for how you use and share your videos.

The Delta Studio gallery. You can choose to share a finished video to the public Delta Studio gallery, where anyone can watch it on its own page with a "Made with Delta Studio" badge. Share only videos you have the right to share, that show no real, named person and no one who has not agreed, and nothing private. A shared video stays in the gallery as long as the video is kept (30 days) and you can remove it at any time; removing it also stops its old links working. Anyone can report a video; a video with several reports is hidden until we check it, and we may remove any video from the gallery, or close the gallery, at any time. Sharing gives us permission to show the video and its title in the gallery and on its page for as long as it is shared.

Pages you publish and apps you release. If you publish a page from Delta Build, or release an app made with Delta AI (for example on Google Play), you are responsible for what it contains and for following the law and that store's rules. Do not publish pages that imitate another person or business, collect passwords or payment details under false pretences, or host anything illegal. We may unpublish a page that breaks these Terms. For Android apps, your zip includes the app's signing key: keep it safe, because Google Play needs the same key for every update, and we cannot recover it for you once the build has been deleted.

7. AI-Generated Content

Delta AI uses artificial intelligence to generate text, images, code, and documents. AI-generated content may contain errors, inaccuracies, or outdated information. You are responsible for reviewing and verifying any content before relying on it, especially for important decisions (legal, medical, financial, or safety-related). Delta AI is a tool to assist you, not a substitute for professional advice. Delta AI does not give financial, investment or trading advice. Information about crypto assets, prices or tokens is general information only. Crypto assets are volatile and you can lose money.

8. Your Content

You retain ownership of the messages, photos, and files you submit to Delta AI, and of the content Delta AI generates for you in response, to the extent permitted by law. You grant us a limited license to process this content solely to provide and improve the Service. You are responsible for having the rights to any content you upload (photos, documents) for editing or analysis.

9. Intellectual Property

The Delta AI name, logo, and branding are the property of Delta AI. The underlying software, design, and infrastructure of the Service are protected by intellectual property laws. These Terms don't grant you rights to our trademarks or branding beyond normal use of the Service.

10. Service Availability

We aim to keep Delta AI available and reliable, but we don't guarantee uninterrupted access. The Service may be unavailable at times due to maintenance, technical issues, or factors outside our control. Features, limits, and pricing may change over time; we'll aim to communicate significant changes through the app or our official channels.

11. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Delta AI is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including reliance on AI-generated content, crypto asset price fluctuations, or issues on third-party blockchain networks (which are outside our control). Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim, or USD 50 if you have not paid us anything. Nothing in these Terms limits any liability that cannot be limited by law.

12. Termination

You may stop using Delta AI at any time. We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or if required by law. Provisions that by their nature should survive termination (such as intellectual property and limitation of liability) will continue to apply.

13. Changes to These Terms

We may update these Terms as Delta AI evolves. We'll update the "Last updated" date above when we do. Continued use of Delta AI after changes take effect means you accept the revised Terms.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles, unless otherwise required by the law of your local jurisdiction.
